I think that is a moment when every sale order is empty. You want to switch from form to list view for every sale order before insert first product line?  
2. I tested your scenario and didn't happen. 
You can see SO0019 from http://www.filsystem.ro:18080/openerp/login?db=demo&user=demo&password=demo 
SO019 is an emty sale order and you can switch from form to list and reverse whenever you want

  Scenario:

  Create an empty sales order
  Navigate to another order with some lines and switch to form view
  Go to sales orders list
  and open the empty order,

  there is no way to switch to list view without creating a new line (my
  guess is that wold be nice to automatically switch to list view if
  empty)
