I'm thinking of a problem here where eg, scale mode is initiated just
to get an *overview* of windows (eg with button or keybinding) but
then if your mouse ends up over another window because of a layout,
that window now becomes "on top" even though you probably didn't
intend it to be.
Maybe the better solution is to select underneath the pointer on one
of those button presses.
