This bugs affecting me too. I've just upgraded directly from 13.04 to
13.10 yesterday. Saw kinda same bug for Xubuntu 13.10, is it possible to
use their solution?

  indicator icon incorrect (shows muted when not muted)

Status in “indicator-sound” package in Ubuntu:
  Confirmed

Bug description:
  Been happening somewhat sporadically since I updated to 13.10 (in
  alpha mode), now 13.10 is stable and it still happens.

  I am listening to music right now and the sound indicators shows a
  muted icon, which is incorrect.

  I attached a screenshot showing sound menu with the indicator as I was
  unable to catch the opened indicator menu, hope that works.

  Running Ubuntu 13.10 x64.
