Bug description:
I have this problem on 13.10 and 14.04

  To reproduce:
  1. Maximize an application window (In the attachment I made qt creator maximized)
  2. Open a new window un-maximized and make it focused (I used nautilus)
  3. Move the cursor to the top panel and click on it
  4. Make sure you don't click on the global menu area and the un-maximized window should have at one menu item
