Just remove the file of there is no other solution. Replace it with a @import or something like that.

However, I can't agree with the closed license of the CSS: if anyone wants to "make a exact replicate of our website", do you really think he will take the licenses into accounts? It is annoying for nothing, it will create more problems than it solves... Anyway, "elementary" can't be used without permissions, can it? So, maybe one could make a replicate, but he couldn't use elementary as a name, so, I don't see any problem. (and what about local team, etc...)
