Threre are no changes regarding this bug in the mainline-kernel.
I tested it with this one: http://kernel.ubuntu.com/~kernel-ppa/mainline/v3.9-raring/ which seems to be the latest version available for raring at the moment.

Title:
  USB-drives don't get high-speed

Status in “linux” package in Ubuntu:
  Incomplete

Bug description:
  When I start my USB hard-drive (using the power switch on it) while it
  is connected to the computer, it is only recognized as "full-speed".
  (dmesg1.log)

  
  But when I disconnect it, start it, wait a second and then connect is to the computer it is properly recognized as "high-speed" device. (dmesg2.log)
