I can see this made it into the 3.12 tree as the following commit:

031afe4990a7c9dbff41a3a742c44d3e740ea0a1 tcp: fix incorrect ca_state in
tail loss probe

I'll build a saucy test kernel with a cherry-pick of this commit and
post a link to it shortly.

       We are planing to widely deploy Ubuntu 13.10 in our frontend server for  advanced TCP enhancement in the latest linux kernel and Tail Loss Probe is considered as one of the most important features, so do please fix this bug.
