Found the problem..

I have a script which runs at boot which changes the permissions for
everything on the shared directory

chmod -R uog+rw /media/shared/*

If I stop this the backup works OK.

Checking the files it does change the atime but not the mtime.

I am testing to see if changing my Fstab from relatime to noatime helps.
