The partner received a notification in its Inbox, this is why he is in
the recipients. If you activate the portal, he bill be able to read its
messages, reply to it, ... However receiving a notification on the Inbox
and receiving it by email is dependent on the 'Receive Email' field.

This is the intended behavior: the partner has been notified but doe
snot want to receive emails. OpenChatter deals with messages and
notifications, not only emails.

Bug description:
  if "Receive Messages by Email=Never" for a partner or contact - no
  message is sent to this address

  Nevertheless in the message the partner is mentioned as addressee,
  which is miss leading, as no message was sent.
