It appears the patch in question is now officially upstream and included
in the upstream v2.6.35 kernel:

Since Maverick has already been rebased on top of upstream v2.6.35, it
subsequently already contains this patch.  I'm therefore marking the
Maverick linux task as Fix Released.  The Lucid task still remains open
and going through the SRU process.
