just put

    Identifier "middle button emulation class"
    MatchIsPointer "on"
    Option "Emulate3Buttons" "on"

in /etc/X11/xorg.conf and you have the emulation again, permanently.
It's not practical to add quirks to the driver, so I'll probably close
this as "opinion".
