Certainly it's possible to use Caps Lock as a key in this way, and interestingly there is precedent: Enso Launcher, from Aza Raskin's Humanized team, used Caps Lock as the activation key (although there it wasn't modal; you had to hold Caps Lock the whole time you were typing), and Enso was sorta-kinda like the HUD, if you look at it from a hundred miles away. Similar kind of principle, anyway :)

If your question was more about "can we make the HUD summoning key switchable" rather than "can Caps Lock be used as the HUD summoning key" then I don't know.
