This is a feature request not a bug.

ephemeral diskss are examplty that.

from an API point of view its expected that data on ephmerl disks will
be lost if you evacuate the instance or on some other move operations.

  No way to forbid evacuation for instance with ephemeral devices

Bug description:
  It's nice to try to evacuate instance and don't loose its ephemeral devices.
  At least it would be fine if Nova checks it and doesn't evacuate an instance with ephemeral devices.
