This issue has gone after installing the correct FIPS compliant userspace packages during the deployment stage.
Tests have been restarted and not failing with this any more.

  bionic/aws-fips: sut-test failed while processing openssh-server

  Fix Released

Bug description:
  For s2024.04.01 bionic:linux-aws-fips the fips_test sut-test fails
  with 'Errors were encountered while processing: openssh-server'. This
  affects the following instances: c3.xlarge, c5n.large, r5.metal,
  t3a.2xlarge. A copy of the c3.xlarge log is attached to this bug
  report.
