This issue has gone after installing the correct FIPS compliant userspace packages during the deployment stage.
Tests have been restarted and not failing with this any more.

  bionic/aws-fips: ubuntu_kvm_smoke_test fails on setup and sut-test

Status in ubuntu-kernel-tests:
  Fix Released

Bug description:
  For s2024.04.01 bionic:linux-aws-fips ubuntu_kvm_smoke_test fails on
  both setup and sut-test for all instances. They have failed in the
  same way for all the test runs I have done but there is no precedent
  with this kernel for this type of failure. I've attached the log for
  c3.xlarge to this bug report.
