Found it. Turn on Workarounds > Keep previws of minimized windows and
empathy -h behaves as described.

  Instead of not displaying a window, 'empathy -h' leaves an invisible
  window on the desktop. Sometimes the empathy window flashes before
  becoming invisible. This is not a brick-wall invisible window as in
  previous unity bugs; this one can be moved and interacted with, and even
  displays tooltips and drag-and-drop objects (i.e. contacts). The empathy
  launcher is not displayed. Selecting "Chat" from the messaging menu
  restores the visibility of the window and makes the launcher appear.
