to reproduce
open any window maximized, enter scale mode, 'zoom' that maximized window using right click (from scale addons), the window will zoom to almost full screen and unity launcher/panel will be on top of it.

doesn't happen when I set launcher to 'never hide', this happens even
it's 'never hide'

the correct way would be for compiz to acknowledge unity launcher/panel
all the time whether it's set to hide or not, since they are going to
show when scale is initiated.
