Why does it exist? Shouldn't the base implementation suffice?

In the current implementation it returns true even for the layer the
module is on, which is IMHO incorrect (why a silk text should be
considered on the front copper layer?). Then follows some crazy check
about silk and adhesive (which I'm ripping out since it has no sense
whatsoever)

The funny thing is that the comment says to look in the header... but
there is nothing there...
