Well if it is the intended behavior, it is rather user - unfriendly.

I assume that you are talking but "opt out" =  'Receive Email'

TO   understand what happens the dummy user has to do some research and
to find the (poorly named) "opt out" field

I doubt that it is easy to understand  the meaning of last line of the
message.

The user must be able to see immediately if a mail has been sent or not
- imagine someone changed the "opt out" value after sending ....

Bug description:
  if "Receive Messages by Email=Never" for a partner or contact - no
  message is sent to this address

  Nevertheless in the message the partner is mentioned as addressee,
  which is miss leading, as no message was sent.
