RaiMan proposed the following answer:
problem since OS X 10.8:
menubar is always on top.

to capture something on the bar:
start left very near below and drag top right.

or use Mac's own capture tool (shift-cmd-4) and load the image into the
IDE with the top left middle button.

or use type(Key.SPACE, Key.CMD) 
to open spotlight.

But this example does not work anyway, since spotlight is changed in
10.10 ;-)
