Public bug reported:

Binary package hint: fglrx

When a user attempts to install fglrx on Maverick via "additional
drivers" or even manually using apt-get they will receive: "Error!
Application of patch use-cflags_module-together-with-modflags.patch
failed" via apt-get or simply just get an error when trying to install
via "additional drivers", installing patch fixes this error in both but
patch is not provided by Maverick in the default install.  So perhaps
make patch a depends or provide patch in the default Maverick install.
