tgeulin confirmed that the question is solved:
ACTIONPARSNIP: here is the only prt of menu.lst tht contains "Windows":
# examples
#
# title		Windows 95/98/NT/2000
# root		(hd0,0)
# makeactive
# chainloader	+1
#
# title		Linux
# root		(hd0,1)
# kernel	/vmlinuz root=/dev/hda2 ro

TOM: the ubuntu OS  seems to have two partitions: ext3 nd linux-swap.
there was nothing else below the automagic list. it must b the osx boot loader because i didnt install inside windows. i will check online.
