Windows "cast" a shadow on the desktop to create the impression that they float above the desktop and are not part of it.

A (non-maximized) window's titlebar touching the panel defines the upper limit for its position (except if you use modifier-key-bound-to-window-control-in-prefs and left-drag ... but that can be considered a bug).

This implies that the panel exists on the same layer as the (focused and raised) window and thus must have about the same shadow.
