Could someone else have bought the phone before you and found that they didn't like it and returned it to get their money back?

The worry is what software might be loaded on the phone that you don't
know about.  If it's phone with an Android OS I would flash the phone
with something you trust, perhaps Cyanogenmod http://www.cyanogenmod.org/
